New Jersey Senate bill S. 511 to increase regulations on the staffing industry has been approved by the New Jersey Senate, according to a tweet by State Sen. Joe Cryan, D-Union, the bill’s sponsor. The bill includes a provision for equal pay between contingent and directly employed workers among other concerns. Some believe it could lead to increased litigation.
The New Jersey Senate previously approved the bill in June but had to vote again because of a procedural issue.
No changes were made to the bill in the new vote, said Toby Malara, VP, government relations, at the American Staffing Association. Efforts to amend the bill had been led by the New Jersey Staffing Alliance with assistance from the ASA.
New Jersey Gov. Phil Murphy now has 45 days to sign the bill, veto it or put forward a conditional veto in which he would offer the bill with amendments back to the legislature for consideration, Malara said. The next path is to urge the governor to issue a conditional veto with a series of changes to the bill.
The bill had been opposed by the New Jersey Business and Industry Association.
“While the intent of the bill is to create additional protections for temporary workers, the provisions in it range from concerning to completely unworkable for businesses which are often challenged enough to maintain their workforces,” said Alexis Bailey, NJBIA director of government affairs.
